1. Scope and parties
This policy applies to downloadable website template source code and to custom web development services provided by Jon-Andrew Martin, an individual operating as a sole proprietor at 602 Lampton Ln, McAlester, OK 74501, USA. It supplements the master services agreement and the site terms of service.
2. Template source code sales: final and non-refundable
All sales of downloadable website template source code are one hundred percent (100%) final and non-refundable once the download has been accessed. Template source code is digital content delivered electronically via a download token; because the content cannot be returned once accessed, no refund is available after the download begins.
Before purchase, review the template description, included features, and technical requirements carefully. If a delivered template is inaccessible, corrupted, or materially different from its description, contact contact@jon-andrew.com promptly; Jon-Andrew will provide a corrected file or replacement link where practical, or a refund where required by applicable mandatory law.
3. Milestone revision limits for custom projects
For custom client projects, the signed Statement of Work states the number of revision rounds included for each milestone. Unless the SOW states otherwise, the default is two (2) rounds of revision per milestone, with each round consisting of consolidated, actionable feedback delivered within the acceptance window described in the MSA.
Revisions that materially change the approved direction or scope, or that are requested after acceptance, are treated as separately scoped change requests rather than included revisions. Additional revision rounds beyond the included limit may be performed at the Developer's then-current rates as a change order.
4. Refund terms for custom contracts
Refund terms for custom projects are set in the signed Statement of Work. Unless the SOW states otherwise, the following applies:
- The initial deposit is non-refundable once work has commenced.
- Fees for completed and accepted milestones are non-refundable.
- If the Developer fails to perform a deliverable that materially conforms to the SOW after a reasonable opportunity to correct it, the Client is entitled to a refund of the portion of fees attributable to that non-conforming deliverable.
- If the Client terminates the project for convenience, the Client owes fees for all work performed through the effective date of termination, including any committed third-party costs.
Nothing in this section limits any right or remedy that applicable mandatory law provides and that cannot be waived.
5. Support and maintenance
Unless a separate paid maintenance agreement expressly commits to a response or resolution target, support is provided on a reasonable best-effort basis. No default response time, resolution time, uptime percentage, or service credit applies. Support requests should be sent to contact@jon-andrew.com with the site, feature, expected behavior, and observed behavior described.
Maintenance work, emergency support, and feature additions outside the SOW are separately scoped and billed. Support is not a security certification, penetration test, legal review, or guarantee against attack.
6. Preservation of legal rights
This policy does not exclude or limit any warranty, remedy, refund right, or liability that cannot lawfully be excluded or limited. Consumers retain all mandatory rights under applicable law. For questions, contact Jon-Andrew Martin at contact@jon-andrew.com or +1 (424) 379-7477. See also the master services agreement, the site terms of service, and the privacy policy.
