1. The website and its owner
jon-andrew.com (the “Site”) is provided by Jon-Andrew Martin, an individual operating as a sole proprietor at 602 Lampton Ln, McAlester, OK 74501, USA (“we,” “us,” or “our”). These Terms of Service (the “Terms”) govern your access to and use of the Site and the services offered through it.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.
2. Permitted use and platform rules
You may browse the public Site and contact us for legitimate inquiries. You may not:
- Use the Site to send unlawful, infringing, or harmful material;
- Impersonate any person or misrepresent your affiliation;
- Distribute malicious software, attempt to gain unauthorized access to non-public files or systems, or interfere with the Site's operation or security;
- Overwhelm, disrupt, or degrade the Site, its servers, or its network, including through denial-of-service attacks or excessive automated requests; or
- Violate any applicable law or regulation in connection with your use of the Site.
Security concerns may be reported privately to contact@jon-andrew.com.
3. Prohibited scraping and automated access
You may not scrape, crawl, harvest, or otherwise extract data, content, or code from the Site through automated means (including bots, spiders, scrapers, or data-mining tools), except as expressly permitted in writing or to the extent required for ordinary search-engine indexing that complies with our robots.txt and standard technical conventions.
You may not use content scraped from the Site to train, develop, or improve any artificial intelligence or machine-learning model, or to populate any competing service, without our prior written consent. This prohibition is in addition to, and not in limitation of, any rights we have under intellectual-property or other law.
4. Intellectual property
All text, design, code, music, images, artwork, and other materials on the Site are owned by us or their respective rights holders and are protected by copyright and other intellectual-property laws. Viewing the Site does not transfer ownership or grant any license to reuse protected material beyond ordinary personal, non-commercial use of the public Site and uses permitted by applicable law.
Music purchased through the Site is governed by the music license terms. Web development deliverables are governed by the master services agreement. You retain rights in materials you provide and represent that you have authority to share them for the requested work.
5. Stripe payment gateway terms
Payments are processed on Stripe-hosted Checkout pages. Before you authorize payment, the invoice or checkout page displays the applicable service or digital product, amount, currency, and any calculated tax. We receive confirmation and the payment details needed to fulfill the order; Stripe receives and processes your payment-card details under its own terms and privacy notice. These terms govern your purchase from Jon-Andrew, while Stripe's terms govern its payment service. Your refund, delivery, and license rights remain those described in the applicable policy below, together with any non-waivable rights under your local law. We are not a bank, payment processor, or money transmitter.
We are not responsible for errors or delays caused by Stripe, your bank, or your card issuer. A payment receipt confirms that payment was processed, not that any particular right or deliverable was included beyond the terms of the applicable agreement. Refunds are governed by the applicable refund policy, including the music refund policy and the template and service refund policy.
6. Availability and accuracy
The Site and its content are provided for general information and may be corrected, updated, or interrupted for maintenance, security, or circumstances outside our control. We make no guarantee of continuous availability or that all content will always be current or suitable for every purpose. No website uptime or response-time guarantee is made by these Terms.
7. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, our aggregate liability arising out of or related to your use of the Site shall not exceed one hundred U.S. dollars ($100.00) or the amount you paid us in the twelve (12) months preceding the claim, whichever is greater.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for fraud, or any mandatory right or remedy under applicable consumer-protection law.
8. Governing law and dispute resolution
These Terms are governed by the laws of the State of Oklahoma and applicable United States federal law, without regard to conflict-of-laws rules. Where mandatory consumer-protection law of your place of residence applies, it is not affected by this choice of law.
We encourage you to contact us directly to resolve any dispute before initiating formal proceedings; doing so is not a condition of any statutory right or remedy. No exclusive court location is imposed on a consumer by these Terms.
9. Changes to these Terms
We may update these Terms from time to time. Updates carry a new effective date and take effect when posted, except that material changes will not apply retroactively to accrued rights or to a completed transaction. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
