1. Scope and parties
This Digital Music Refund & Delivery Policy (the “Policy”) applies to all purchases of digital audio files and ZIP albums from Jon-Andrew Martin, an individual operating as a sole proprietor at 602 Lampton Ln, McAlester, OK 74501, USA. This Policy is incorporated into the music license terms and the site terms of service. By purchasing a digital album, you agree to this Policy.
2. Delivery protocol
Digital albums are delivered by email in the form of an immediate, single-use download token that resolves to a download link at https://jon-andrew.com/api/download. The token is sent to the email address you provide at checkout immediately after payment confirmation.
- Each token is valid for 48 hours from issue and automatically expires at the end of that period.
- Each token permits a maximum of three (3) download attempts.
- The token is single-use for a completed download: once a download completes successfully, the token is revoked and cannot be reused.
You are responsible for providing a valid email address, for checking that address (including spam or junk folders), and for downloading and backing up the delivered files before the token expires. If you do not receive the delivery email, contact contact@jon-andrew.com promptly with your order reference.
3. Finality of digital sales
All digital album sales are final and non-refundable once the download token has been accessed or executed. “Accessed or executed” means that a download attempt has been initiated using the token. Once the download process has begun, the digital content is considered delivered and no refund will be issued.
This finality reflects the nature of digital audio content: once delivered, digital files cannot be returned. However, this finality does not apply, and is not a waiver of, any right or remedy that applicable mandatory law provides and that cannot be waived.
4. Statutory withdrawal (EU/UK) waiver
For consumers located in the European Union, the United Kingdom, or another jurisdiction that provides a statutory right of withdrawal for digital content, the following applies. By requesting immediate performance and initiating the download of digital audio content, you expressly acknowledge and agree that:
- You request that Jon-Andrew supply the digital content, and begin its performance, during the statutory withdrawal period; and
- You acknowledge that once the download begins you lose your statutory right of withdrawal.
Jon-Andrew will confirm your consent to immediate performance, and your acknowledgment of the loss of the right of withdrawal, as part of the checkout process before the download token is issued. Where applicable law requires a durable confirmation of this consent and acknowledgment, it will be provided with your order confirmation.
5. Defective, missing, or incorrect files
If a delivered file is inaccessible, materially corrupted, incomplete, or materially different from the description at the time of purchase, email contact@jon-andrew.com promptly with your order reference, the file or link involved, and a description of the problem. Do not send payment-card details or passwords.
Jon-Andrew will first attempt to provide a corrected file or replacement link where practical. If the defect cannot reasonably be corrected, or if a refund is required by this Policy or applicable mandatory law, the affected payment will be refunded in whole or in the proportion required by the circumstances. A technical defect that prevents delivery is distinct from the finality rule above and will be handled as a customer-support matter.
6. Circumstances that are not grounds for refund
Except as required by applicable law or as expressly provided in this Policy, a refund is not owed where:
- The files were delivered but no longer suit a personal preference;
- A third-party platform rejected an unlicensed use;
- The files were used outside the scope of the music license; or
- The buyer simply changed their mind after the download began.
7. How refunds are processed
Approved refunds are issued through Stripe, the hosted payment provider, to the original payment method. Jon-Andrew does not require your full card number. Refund timing depends on Stripe and your bank. If the original payment method is unavailable, contact Jon-Andrew to arrange a lawful alternative; do not send payment information by ordinary email.
8. Preservation of legal rights
Nothing in this Policy limits or waives any right, remedy, guarantee, or refund right that applicable law makes mandatory and that cannot be excluded or waived by agreement. Where local consumer law provides greater protection than this Policy, that protection prevails. You may contact Jon-Andrew about a delivery issue before opening a payment dispute, but doing so is not required and does not change any statutory deadline or right.
9. Updates and contact
This Policy may be updated from time to time; updates carry a new effective date. An update does not retroactively change the terms of a completed purchase. For questions, contact Jon-Andrew Martin at contact@jon-andrew.com or +1 (424) 379-7477. See also the music license terms, the site terms of service, and the privacy policy.
